1.Acceptance of Terms
These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you” or “Customer”) and TeleRadar (“TeleRadar,” “we,” “us,” or “our”), governing your access to and use of the TeleRadar platform, including all related websites, application programming interfaces, software development kits, dashboards, and associated documentation (collectively, the “Service”).
By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting on behalf of an organization, you represent that you have the authority to bind that entity.
2.Nature of the Service
TeleRadar provides a Telegram automation platform that enables real-time channel monitoring, message filtering, bot-assisted forwarding, AI-powered summarization, and analytics dashboards. The Service processes data from Telegram’s public and authorized private channels on behalf of our customers.
We do not guarantee uninterrupted access. Service availability may be affected by Telegram API changes, scheduled maintenance, or force majeure events. Current uptime metrics are published at teleradar.org/status.
3.Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete registration information. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unauthorized purposes.
4.License and Acceptable Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes.
You shall not:
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or use automated means to extract data from the platform beyond documented API usage
- Use the Service to facilitate illegal activity, spam, harassment, or copyright infringement
- Resell, sublicense, or redistribute access to the Service without prior written consent
- Interfere with or disrupt the integrity of the Service or its underlying infrastructure
5.Fees, Billing, and Taxes
Paid subscriptions (Economy and Pro plans) are billed on a recurring monthly or annual basis. All fees are stated in USD and are non-refundable except as expressly provided herein or required by applicable law.
Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. Refund requests are honored within 14 days of the original purchase date. Contact support@teleradar.org for billing inquiries.
You are responsible for all applicable taxes. If we are required to collect or remit taxes on your behalf, they will be added to your invoice.
6.Intellectual Property; Customer Data
All rights, title, and interest in the Service, including all intellectual property rights, remain with TeleRadar. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You retain all rights to data you submit to or process through the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and improve the Service. We will not sell Customer Data to third parties.
7.Data Processing and Privacy
Our collection and use of personal information is governed by our Privacy Policy. Where we process personal data on your behalf, the terms of our Data Processing Agreement apply.
We implement industry-standard security measures including AES-256 encryption at rest, TLS 1.3 in transit, and per-tenant key isolation. For a detailed security overview, see our Security page.
8.Confidentiality
Each party agrees to hold the other party’s Confidential Information in confidence using at least the same degree of care it uses to protect its own confidential information. Confidential Information does not include information that is publicly available, independently developed, or rightfully received from a third party without restriction.
9.Export Controls and Sanctions Compliance
You represent that you are not located in, or a national or resident of, any country subject to comprehensive trade sanctions, and that you will not use the Service in violation of any applicable export control or sanctions laws.
10.Warranties and Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for delays or failures resulting from Telegram API changes, third-party service outages, or network conditions beyond our control.
11.Indemnification
You agree to indemnify, defend, and hold harmless TeleRadar and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELERADAR’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO TELERADAR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL TELERADAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
13.Term and Termination
These Terms remain in effect until terminated. You may terminate your account at any time through the dashboard settings. We may suspend or terminate your access if you breach these Terms, with or without prior notice.
Upon termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue to apply.
14.Dispute Resolution
Any dispute arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the Istanbul Arbitration Centre (ISTAC), conducted in English. The seat of arbitration shall be Istanbul, Turkey. Each party shall bear its own costs of arbitration.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.
15.Miscellaneous
These Terms constitute the entire agreement between you and TeleRadar regarding the Service. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right does not constitute a waiver.
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
